1. BOOKING FEE, Deposit 

a) By booking with Bernadette Photography you enter into a contract and have therefore agreed to abide by the terms and conditions. b) Booking fees -Deposits taken for all sessions are non refundable except in the event Bernadette cancels the booking.  3 )A deposit will be required to secure your booking and it will be deducted from the cost of the client’s chosen package when calculating the final balance due..  Once this has been paid your slot will be reserved and blocked out in my diary. Payment in full of the remaining balance will be due on the day of the session.

Additional products ordered must be paid for in full at the time of ordering. 


Bernadette Photography will store Client names, contact details and session information privately and will not share these with any other business or organisation. 

They will only be stored via email and the images will be stored on an external hard drive which can only be accessed by Bernadette Barna Toth.

You have the right to access personal information held about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact


The Client will be presented with a carefully chosen selection of images by Bernadette Photography. These images will be in the form of JPEG’s. The Client will not have access to any unedited images or RAW image files. Bernadette Photography shall not be held responsible for the loss of images once they have been delivered. 


All images will be adjusted for exposure, brightness, contrast, sharpness, colour correction etc. The Photographer’s judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artistic finishing is also included.

Bernadette Photography will endeavour to achieve a pleasing overall colour balance. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.


Delivery of images shall be given via a private online password protected gallery where the Client may view and choose their images. They may create selections of favourite images along with purchasing addition professional printed products and albums. Images shall be delivered within 2-3 weeks from the ordering date. Bernadette Photography will always endeavour to deliver your photographs as soon as possible.


There is no right to reject photographs on the basis of style or composition as it is the client’s responsibility to view the photographer’s portfolio. In the event of major technical problems with photographs Bernadette Photography will either reprint images or repeat the photo shoot.


Photo sessions may involve physical activity. This is undertaken at the your own risk. All children under the age of 18 need to be accompanied by a parent or parental guardian.

Bernadette Photography holds full Public Liability Insurance.


The style and the number of photographs are dependent on vagaries of the weather and the availability and willingness of the clients. The Photographer will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture.


Bernadette Photography retains full copyright in all images, at all times, throughout the world, in accordance with the Copyright, Designs and Patents Act 1988.  The photographer asserts her right to be identified as the author of all images, by the words: ‘Photo by Bernadette Photography’


The photographer grants the Client a license of use. The images taken by the photographer are for personal use only by the client and their family and friends, at no additional cost. The Client does not have permission to use the photographs for commercial use.


The client(s) hereby recognise(s) that the photographer may use any of the session images for business promotions, advertising, social media, brochures, websites, sample albums etc unless the subjects express the wish for this not happen prior to the event.

Bernadette will always seek permission to publish your photographs on any of these platforms. Bernadette will always respect your wishes if you prefer your photographs not to be used. 

The Client may publish photographs to social media if they wish. Images may not be edited or have filters applied to them. The Client agrees to not digitally manipulate the work for public viewing (social networking, website or public photo galleries) and agrees to include a photo credit of “Photo By: Bernadette Photography” with each selection of photographs shared.


Once digital files from your photoshoot are handed over it’s your responsibility to take measures to ensure they’re securely backed up in several places. Bernadette Photography recommends portable hard drives & online cloud storage facilities. Bernadette Photography cannot guarantee files will be kept, however every measure is taken to keep them safe.


All digital negatives (computer files) remain the property of the photographer.

All digital packages include a copy of the edited digital negatives to the client(s) for their own non-commercial use.


The photographer grants the client a print release on all photographs for personal use only. There is no limit on how many times the photographs may be printed.


Any payment made to us (deposit and/or final balance settlement) indicates that you have read and understood all the terms and conditions as set out in this document, in its entirety. Your payment signifies acceptance of these terms and conditions as a legally binding contract, unless otherwise objected to explicitly and in writing, prior to accepting our service. No variation of the terms and conditions of this contract shall be recognised unless explicitly agreed to in writing


In the unlikely event of total photographic failure beyond the Photographer’s control, our liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

ln line with distance selling regulations, if you are booking a session online you have a cooling off period of 14 days available to you to cancel your session. This will not be available once your session date is reached or passed or after those 14 days. You must contact me in writing to to cancel a booking inline with these regulations.

Due to the nature of digital photography and the fact that all photographs may be viewed by the client on our website prior to purchase, once orders have been sent, Bernadette Photography has a strict NO REFUND/RETURN/EXCHANGE POLICY. Once a transaction has been completed, it is then considered non-refundable. 

Bernadette Photography is by no means responsible for the quality of services (printing and other) provided by its business partners/other 3rd parties.

This agreement shall be governed by the laws of England & Wales


These Terms and Conditions shall not be varied except by agreement in writing.
