Data protection is of a particularly high priority for Bernadette Photography. We provide this notice to explain our online information practices and the choices you can make about the way your information is collected and used. This notice applies to all information collected or submitted on the Bernadette Photography website.
THE DPA & GDPR MAY 2018
This website complies with the DPA (Data Protection Act 1998) and already complies with the GDPR (General Data Protection Regulation) which comes into effect from May 2018. We will update this policy accordingly after the completion of the UK’s exit from the European Union.
We take care over the processes around looking after personal data stored on our physical systems. Bernadette Photography holds the following personal data of clients:
- names
- email addresses
- phone numbers
within soft copy and sometimes hard copy contracts as well as soft copy wedding client ‘day plan’ documents. Soft copy contracts and day plans are safely stored on a password protected home office MacBook and also kept on file on GDPR compliant Gmail servers.
Client photos are safely stored within a password protected home office MacBook and backed up to two encrypted external hard drives. An additional cloud copy of all images is stored on GDPR compliant Dropbox or iCloud.
Furthermore we may collect and process the following information from you:
- Information that you provide by arranging any photoshoot or information about the people to be included in a photoshoot or event. This includes information provided at the time of commissioning us to undertake a photoshoot or event, subsequent information submitted to us through the process of arranging the photoshoot or event or requesting further information from us about your photoshoot or event.
- Specifically, personal details such as name, location, email address and any other information submitted by you when arranging a photoshoot or event through the Site.
- The website of the Bernadette Photography contains information that enables a direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.
- Your personal information is kept private and stored securely until a time it is no longer required or has no use.
- Protecting the privacy of the very young is particularly important to Bernadette Photography. For that reason, we never collect or maintain information at our website from those we actually know are under the age of 13, and no part of our website is structured to attract anyone under 13 to provide information to us.
- We adopt a Social Media Policy to ensure our business and our staff conduct themselves accordingly online. While we may have official profiles on social media platforms users are advised to verify authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for user passwords or personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media. There may be instances where our website features social sharing buttons, which help share web content directly from web pages to the respective social media platforms. You use social sharing buttons at your own discretion and accept that doing so may publish content to your social media profile feed or page. - Bernadette Photography offers users the possibility to leave individual comments on individual blog contributions on a blog, which is on the website of the controller. A blog is a web-based, publicly-accessible portal, through which one or more people called bloggers or web-bloggers may post articles or write down thoughts in so-called blogposts. Blogposts may usually be commented by third parties. If a data subject leaves a comment on the blog published on this website, the comments made by the data subject are also stored and published, as well as information on the date of the commentary and on the user’s (pseudonym) chosen by the data subject. In addition, the IP address assigned by the Internet service provider (ISP) to the data subject is also logged. This storage of the IP address takes place for security reasons, and in case the data subject violates the rights of third parties, or posts illegal content through a given comment. The storage of these personal data is, therefore, in the own interest of the data controller, so that he can exculpate in the event of an infringement. This collected personal data will not be passed to third parties, unless such a transfer is required by law or serves the aim of the deffense of the data controller.
CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Bernadette Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Bernadette Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Bernadette Photography as detailed in this privacy policy.
In terms of explicit GDPR compliance, wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Bernadette Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.
Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.
WITHDRAWAL OF CONSENT
Anyone photographed by Bernadette Photography, whether a client or wedding guest, and whether past or current may withdraw consent for a photograph in which they appear to be displayed. The process for this is to email Bernadette Photography at bernadette.barna@gmail.com specifying the photo in question. Persuant to the request,Bernadette Photography will then remove the photo from online and printed display wheresoever it appears.
DISPLAY OF IMAGES
We may display any photographs to promote Bernadette Photography on the Bernadette Photography website and blog, on social media, on wedding photography related websites, in exhibitions, in advertising, brochures, magazine articles and other such material, providing that the images used are used lawfully and without damage to Bernadette Photography’s client(s). The rights of the people captured in these photographs are protected by Bernadette Photography as detailed in this privacy policy.
CHANGES TO OUR PRIVACY POLICY
We reserve the right to modify this Privacy Policy at any time. Any changes we may make to our Policy in the future will be notified and made available to you using the Site. Your continued use of the services and the Site shall be deemed your acceptance of the varied Privacy Policy.
